शीतल ठाकुर के पीएचडी प्रवेश से संबंधित मामले में व्यक्तिगत रूप से में 29 जुलाई को उपस्थित रहने का आदेश दिया है।

शीतल ठाकुर बनाम एचपीयू और अन्य मामले में सीडब्ल्यूपी नंबर 10923 में माननीय उच्च न्यायालय ने हिमाचल प्रदेश विश्वविद्यालय के डीन ऑफ स्टडीज और रजिस्टर को यूजीसी-जेआरएफ में शीतल ठाकुर के पीएचडी प्रवेश से संबंधित मामले में व्यक्तिगत रूप से में 29 जुलाई को उपस्थित रहने का आदेश दिया है।

एसएफआई का बहुत मजबूत तर्क है कि पीएच.डी. प्रवेश लंबे समय से गंभीर चिंता का विषय रहा है और बहुत ही दयनीय बात यह है कि विश्वविद्यालय प्रशासन मामलों को पारदर्शी तरीके से निपटाने में हमेशा के लिए अक्षम साबित हुआ है।

ऐसे मामले सामने आए हैं जहां इस विश्वविद्यालय के प्रोफेसर ने योग्यता के आधार पर नहीं बल्कि विज्ञापित सीटों से अधिक सीटें अवैध रूप से बढ़ाकर अपने वार्ड का प्रवेश सुनिश्चित किया। कुछ मामलों में विश्वविद्यालय के प्राधिकारी शिक्षक अपने बच्चों को पीएच.डी. में सफलतापूर्वक प्रवेश दे रहे हैं। बिना किसी प्रवेश परीक्षा के और यूजीसी विनियमन के प्रावधान के खिलाफ पाठ्यक्रम। 

वर्तमान मामलों में विश्वविद्यालय ने एक समिति का गठन किया जब सामाजिक विज्ञान संकाय के तहत लाइफ लॉन्ग लर्निंग विभाग (डीएलएल) ने पीएचडी शुरू करने की प्रक्रिया शुरू की। हालाँकि ग्रामीण विकास में पीएच.डी. 24.1.2017 को माननीय कुलाधिपति या राज्यपाल की सहमति के बाद 2020 से एक ही विषय में अंतःविषय अध्ययन विभाग (डीआईएस) में पहले से ही चल रहा था।

फिर पीएचडी के विवाद को निपटाने के लिए 8.8.2022 को डीन ऑफ स्टडीज द्वारा पवन गर्ग की अध्यक्षता में एक समिति का गठन किया गया। दो अलग-अलग विभागों से एक ही विषय में। उस समिति द्वारा किसी भी निर्णय के लंबित रहने के दौरान डीन ऑफ स्टडीज के कार्यालय ने किसी भी निर्णय की प्रतीक्षा किए बिना पीएचडी के लिए सीटें विज्ञापित कर दीं। 11.1.2023 को डीएलएल से और अंततः 5.6.2023 को छात्रों को प्रवेश दिया गया। इससे समस्या उत्पन्न हो गयी है. 

अब अंतःविषय अध्ययन विभाग (डीआईएस) के पास सात रिक्त सीटें उपलब्ध हैं, जिसमें माननीय उच्च न्यायालय ने याचिकाकर्ता (शीतल ठाकुर) को प्रवेश देने का आदेश दिया है, लेकिन विश्वविद्यालय प्राधिकरण ने दूसरे (दूसरे) के गठन द्वारा उक्त आदेश को भ्रमित कर दिया है। 8.8.2022 के बाद) 12.7.2024 को नीलिमा कंवर के अधीन हाई पावर कमेटी। उक्त समिति की बैठक 16, 17 एवं 19 जुलाई, 2024 को लगातार हुई लेकिन उक्त समिति द्वारा कोई महत्वपूर्ण निर्णय नहीं लिया गया। समिति के एक सदस्य कानून के प्रोफेसर ने अपनी असहमति व्यक्त करते हुए कहा है, 

''मेरा मानना है कि पीएच.डी. ग्रामीण विकास में डिग्री दोनों विभागों यानी डीआईएस और डीएलएल द्वारा प्रदान की जानी चाहिए। इसके अलावा, दोनों विभागों को एक ही संकाय यानी पर्यावरण, विकास और स्थिरता अध्ययन संकाय के अंतर्गत रखा जाएगा।''

एसएफआई की पुरजोर मांग है कि जब सब कुछ कोर्ट को तय करना है तो यूनिवर्सिटी अथॉरिटी का क्या फायदा। हमने देखा है कि छात्रों को अनावश्यक रूप से अदालत जाने के लिए मजबूर किया जा रहा है, कुछ समय में धोखाधड़ी करने वाले विश्वविद्यालय शिक्षक अपने बच्चों को पीएचडी में प्रवेश दे रहे हैं। और गंभीर और बुद्धिमान छात्रों की कीमत पर अन्य पाठ्यक्रम, कुछ समय के लिए पीएचडी के लिए एसटी सीटें। सामान्य श्रेणी में परिवर्तित कर दिया गया है, कुछ समय के लिए निहित स्वार्थ के कारण पी.एच.डी. एक विषय को दो विभागों में पेश किया गया है और डीआईएस और डीएलएल के बीच वर्तमान संघर्ष इसका उत्कृष्ट उदाहरण है। यह समस्या किसी और ने नहीं बल्कि डीन ऑफ स्टडीज और डीन सोशल साइंसेज ने पैदा की है। 

इसलिए एसएफआई एक बार फिर मांग करती है कि माननीय उच्च न्यायालय के आदेशों का पालन करते हुए पीएचडी में प्रवेश दिया जाए। यूजीसी-जेआरएफ उत्तीर्ण शीतल ठाकुर को कोर्स दिया जाए और बाकी रिक्त पीएचडी के लिए तुरंत प्रवेश कराया जाए।

In a CWP No. 10923 titled as Sheetal Thakur vs HPU and others case Hon’ble High Court has ordered to the Dean of Studies and Register of Himachal Pradesh University remain present personally in case related to Ph.D. admission to Sheetal Thakur a UGC-JRF holder and other eligible candidates. 

SFI has a very strong contention that Ph.D. admission is a matter of grave concern since long and very pathetically university administration has been proved incompetent to settle the cases once for all in a transparent manner.

There have been cases where professor of this university ensured his/her ward admission not via merit but by increasing the seats illegally beyond the advertised seats. In some cases university teachers in authority have been successfully admitting their wards to Ph.D. courses without any entrance examination and against the provision of UGC Regulation. 

In the present cases university constituted a committee when Department of Life Long Learning (DLL) under the Faculty of Social Sciences started process to introduce the Ph.D. in Rural Development however Ph.D. in same subject was already running in the Department of Interdisciplinary Studies (DIS) since 2020 after the assent of Hon’ble Chancellor or the Governor on 24.1.2017. 

Then a committee under the chairmanship of Pawan Garga was constituted by the Dean of Studies on 8.8.2022 to settle the dispute of Ph.D. in same subjects from two different departments. During the pendency of any decision by that committee Office of Dean of Studies without waiting for any decision advertised the seats for Ph.D. from DLL on 11.1.2023 and finally admitted students on 5.6.2023. This has created problem. 

Now there are seven vacant seats available with the Department of Interdisciplinary Studies (DIS) in which the Hon’ble High Court has ordered to give admission to the petitioner (Sheetal Thakur) but university authority has confused the said order by constitution of another (second after 8.8.2022) high power committee under the Nilima Kanwar on 12.7.2024. That committee meeting held continuously on 16, 17 & 19 July, 2024 but no significant decision has been taken by the said committee. The one committee member Professor from laws has given his dissent as “I am of the considered view that the Ph.D. degrees be awarded by both the departments i.e., DIS and DLL in Rural Development. Further, both the departments be placed under a single faculty i.e. Faculty of Environment, Development and Sustainability Studies.”

SFI strongly demands that when everything is to be decided by the Court than what is the use of university authority. We have noticed that students are being forced to move to the court unnecessary some time fraud university teachers are admitting their wards in Ph.D. and other courses at the cost of serious and intelligent students, some time ST seats for Ph.D. is converted to general category, some time due the vested interest Ph.D. in one subject is introduced in two department and present conflict between DIS and DLL is the classic example. This problem has been created by none other than Dean of Studies and Dean Social Sciences. 

Therefore, once again SFI demands that by complying the orders of the Hon’ble High Court, admission to Ph.D. course be given to UGC-JRF qualified Sheetal Thakur and immediately entrance may be conducted for rest vacant Ph.D. seats in Rural Development in the Department of Interdisciplinary Studies.
